1. AGREEMENT TO TERMS
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “user”) and Alphatrends Publishing LLC (“Alphatrends,” “we,” “us,” or “our”), governing your access to and use of Alphatrends.net and all related services, memberships, products, content, communities, courses, webinars, videos, communications, and materials (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use immediately.
We reserve the right to modify these Terms at any time. Updated versions will be posted with a revised “Last Updated” date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
2. EDUCATIONAL PURPOSE AND RISK DISCLOSURE
All content provided through the Services is for educational and informational purposes only and should not be construed as financial, investment, legal, tax, or professional advice, or as a recommendation to buy or sell any securities.
Alphatrends does not provide brokerage services, investment advisory services, portfolio management, trade execution, or managed account services. Nothing contained within the Services creates any advisory, fiduciary, professional, or client relationship.
Trading and investing involve substantial risk, including the possible loss of capital. Past performance is not indicative of future results, and no representation is being made that any account will or is likely to achieve profits or losses similar to those discussed.
Any examples, commentary, opinions, charts, trade ideas, testimonials, or success stories:
- are illustrative only
- reflect individual experiences
- are not typical
- do not guarantee future performance or success
You are solely responsible for your own financial, trading, and investment decisions and for evaluating the risks associated with such decisions.
3. USER ELIGIBILITY
You must be at least 13 years old to use the Services.
If you are under 18 years old, you represent that you have obtained permission from a parent or legal guardian.
4. ACCOUNTS AND ACCESS
You agree to:
- provide accurate and current information
- maintain the confidentiality of your login credentials
- be responsible for all activity occurring under your account
Your access to the Services is personal, revocable, non-transferable, and for personal, non-commercial use only.
Violation of these access and sharing restrictions may result in immediate suspension or termination of your account without notice or refund.
Account sharing, password sharing, redistribution of access, resale of memberships, rebroadcasting, reposting, livestreaming, commercial use, or group sharing of content is strictly prohibited.
We reserve the right to investigate suspected unauthorized sharing, redistribution, piracy, or misuse of our content and may suspend or terminate access without notice.
5. SUBSCRIPTIONS AND BILLING
By purchasing a subscription or membership, you agree that:
- subscriptions renew automatically unless canceled prior to renewal
- you authorize recurring charges to your selected payment method
- cancellation takes effect at the end of the current billing cycle
- any prorated refunds are issued solely at the Company’s discretion and are evaluated on a case-by-case basis
- access may be suspended or terminated for failed or declined payments
We reserve the right to modify pricing, plans, features, or membership structures at any time.
6. PAUSE AND PRICING POLICIES
Where offered:
- subscription pauses are highly discouraged and are granted solely at our discretion
- pauses may be limited in duration or frequency
- pauses may affect renewal and billing dates
Special, promotional, discounted, or grandfathered pricing:
- may be forfeited upon cancellation
- may not be reinstated upon reactivation
- may be modified or discontinued at our discretion
7. PAYMENTS
All payments are processed through third-party payment providers.
You agree to provide current, complete, and accurate billing information.
We do not sell or share your personal information except with required third parties necessary to operate our services and process transactions (for example, payment processors and payment platforms).
We reserve the right to:
- refuse or cancel orders
- correct pricing or billing errors
- limit or restrict purchases
- reject transactions suspected of fraud, abuse, or unauthorized activity
8. REFUND POLICY
All sales are final.
We do not offer refunds for products, services, subscriptions, memberships, courses, digital content, webinars, or downloadable materials.
By completing a purchase, you acknowledge and agree to this Refund Policy.
In limited circumstances, we may grant a refund at our sole discretion. Any such refund:
- is an exception
- does not establish a precedent
- may exclude processing fees, transaction fees, administrative costs, merchant fees, or other non-recoverable costs
By purchasing, you acknowledge that digital content, memberships, and services may be delivered immediately upon purchase, and that access to such materials constitutes partial or full performance of the transaction.
Dissatisfaction, lack of profitability, market losses, or disagreement with educational content does not qualify for a refund.
If a chargeback, payment dispute, or reversal is initiated, we reserve the right to:
- contest the dispute
- provide evidence of these Terms and transaction history
- terminate or suspend access
- prohibit future purchases, memberships, or access to Alphatrends services
- recover refunded amounts, fees, and associated costs
- pursue any remedies available under applicable law
9. INTELLECTUAL PROPERTY
All content, materials, trademarks, branding, logos, videos, charts, text, graphics, educational materials, website content, course materials, newsletters, and related intellectual property are owned by or licensed to Alphatrends and are protected by copyright, trademark, and other applicable laws.
This includes, without limitation:
- Alphatrends branding
- Brian Shannon branding
- logos
- proprietary educational frameworks
- videos
- webinars
- written content
- charts
- graphics
- slogans
- course materials
Subject to compliance with these Terms, Alphatrends grants you a limited, non-exclusive, non-transferable, revocable license to access the Services solely for your personal, non-commercial use.
You may not:
- copy, reproduce, republish, upload, distribute, transmit, modify, sell, license, or exploit content
- share content publicly or privately outside permitted use
- repost or rebroadcast content
- redistribute materials within paid groups, communities, or classrooms
- use the Services to compete with Alphatrends
- remove copyright or proprietary notices
- commercially exploit any content or materials
10. AI, SCRAPING, AND AUTOMATED USE RESTRICTIONS
You may not:
- scrape, harvest, extract, or collect data from the Services
- use bots, crawlers, spiders, scripts, or automated tools
- create datasets from our content
- use any content, videos, materials, data, text, or information from the Services to train artificial intelligence systems, machine learning models, large language models, or similar technologies without prior written consent
Unauthorized automated use or AI-related usage is strictly prohibited.
11. PROHIBITED ACTIVITIES
You agree not to:
- misuse the Services
- attempt unauthorized access
- interfere with platform functionality or security
- upload malicious code or harmful software
- harass, threaten, abuse, or impersonate others
- engage in fraud or deceptive conduct
- use the Services in violation of applicable laws
- use the Services for unauthorized commercial purposes
- use the Services to compete with Alphatrends
12. USER CONTRIBUTIONS
If you submit, post, or share content through the Services or related communities (including Discord or similar platforms), you:
- grant Alphatrends the right to use, display, reproduce, distribute, and publish such content
- represent that you have the right to provide such content
- remain solely responsible for your submissions
We reserve the right to remove or moderate content at our discretion.
Any feedback, ideas, comments, suggestions, or submissions provided to Alphatrends may be used by us without restriction or compensation.
13. THIRD-PARTY SERVICES
The Services may integrate with or rely upon third-party platforms, including payment processors, analytics providers, community platforms, email systems, or video hosting services.
We are not responsible for:
- third-party content
- platform outages
- external policies
- third-party conduct or practices
Your use of third-party services may also be governed by those providers’ own terms and policies.
14. MONITORING AND ENFORCEMENT
We reserve the right to monitor usage of the Services for:
- security
- fraud prevention
- policy enforcement
- quality control
- intellectual property protection
- operational purposes
We may investigate suspected violations and cooperate with law enforcement or third parties where appropriate.
15. SERVICE AVAILABILITY
We do not guarantee uninterrupted or error-free access to the Services.
We may:
- modify, suspend, restrict, or discontinue Services
- perform maintenance or updates
- remove content or features
We are not liable for downtime, interruptions, delays, errors, outages, data loss, or technical issues.
16. TERMINATION
We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, for:
- violations of these Terms
- suspected misuse
- piracy or unauthorized sharing
- non-payment
- fraudulent or abusive conduct
No refunds will be issued upon termination.
17. DISCLAIMER OF WARRANTIES
The Services are provided “as is” and “as available.”
To the fullest extent permitted by law, Alphatrends disclaims all warranties, express or implied, including:
- merchantability
- fitness for a particular purpose
- accuracy
- non-infringement
- availability
- reliability
We make no guarantees regarding:
- profitability
- trading success
- uninterrupted access
- accuracy or completeness of content
18. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Alphatrends and its owners, employees, contractors, affiliates, agents, and licensors shall not be liable for:
- financial losses
- trading losses
- lost profits or revenue
- indirect damages
- consequential damages
- incidental damages
- punitive damages
- loss of data
- business interruption
Your use of the Services is entirely at your own risk.
In all circumstances, Alphatrends’ total liability shall not exceed the amount paid by you to Alphatrends during the three (3) months preceding the event giving rise to the claim.
Certain jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
19. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Alphatrends and its affiliates, owners, employees, contractors, licensors, and agents from any claims, damages, liabilities, costs, or expenses arising from:
- your use of the Services
- your trading or investment decisions
- your violation of these Terms
- your misuse of content
- your infringement of intellectual property rights
- your conduct toward other users
20. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
21. DISPUTE RESOLUTION
Any dispute arising from these Terms or the Services shall first be attempted to be resolved through informal negotiation.
If unresolved, disputes shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA).
You waive:
- the right to a jury trial
- the right to participate in class actions
- the right to participate in representative proceedings
Any arbitration or claim must be brought individually.
22. PRIVACY POLICY
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
23. MISCELLANEOUS
These Terms constitute the entire agreement between you and Alphatrends regarding the Services.
If any provision is found unenforceable, the remaining provisions shall remain in effect.
Our failure to enforce any provision shall not constitute a waiver.
We may assign our rights or obligations under these Terms at any time.
